Judge Acknowledges Error, Reinstates Hope for Federally Fired Employees Under Trump

By taking up the union’s case, Northern District of California Judge William Alsup has significantly improved the likelihood of federal employees regaining their jobs. This legal action further fuels the broader discussion surrounding President Trump’s potential overreach in reducing the size of the federal workforce since assuming office in January.

What To Know

On March 24, in an issued opinion, Judge Alsup admitted that he had erred in not accepting the case filed by federal employees represented by the American Federation of Government Employees and the American Federation of Labor.

In a statement released on March 14, White House Press Secretary Karoline Leavitt firmly denounced Alsup for his involvement in an analogous matter. She asserted that the judge’s conduct was not in accordance with the Constitution.

Mistaken Ruling

Alsup stated: “Initially, I adhered to three recent rulings from other district courts which determined that claims filed by public-sector unions regarding dismissals of federal employees needed to go through the Merit Systems Protection Board and/or the Federal Labor Relations Authority. Consequently, these cases were outside the scope of the district court’s subject-matter jurisdiction.”

“Following additional instructions, though, this directive confirms that the district court indeed has subject-matter jurisdiction over these claims made by public-sector unions, and that my previous decision stating otherwise was incorrect,” he penned.

If the case had proceeded through the merit board or the Federal Labor Relations Authority, it would have been considerably simpler for Trump to appoint individuals who could counter the employees’ claims effectively.

By taking the case to a federal court, Judge Alsup has significantly bolstered the employees’ claim.

Unions Suffered Injury

Aalsup acknowledged the unions’ assertions that their groups would suffer harm if it was determined that the employees had been improperly dismissed.

“How did they get injured? The illegal layoffs of their members lead to public-sector unions losing dues, having to redirect or increase resources to support those laid off, and facing various legal injustices,” he noted.

Trump Lawyers ‘Vague Out’

Aalsup similarly took issue with the attorneys from the Trump administration for not addressing previous case law.

“In evaluating this case law, defendants become ambiguous; they make no effort to demonstrate how the specifics of this case align with the initial series of cases. Instead, they simply state that plaintiffs fail to ‘differentiate the circumstances of their case,’” he noted.
